General terms and conditions of sale

Article 1 : Introduction
The General Terms and Conditions of Sale apply exclusively between WINE RL, 116 Impasse du Pastrihoun, 13300 Salon-de-Provence (France) (hereinafter "We") and any person visiting or making a purchase (hereinafter "You") via the website www.winerl.com (hereinafter the "Site"). Each use of the Site and/or placing of an order implies having previously consulted and accepted all of these general terms and conditions of sale. WINE RL's General Terms and Conditions of Sale may be subject to change, the applicable terms and conditions are those in effect on the Site at the time the order is placed.

Article 2 : Contract

2.1 Conditions for placing an order

In accordance with Article L. 3342-1 of the French Public Health Code, you must be at least eighteen (18) years old on the date of the order.

Furthermore, you declare that you have the legal and financial capacity to place an order on the Site.

2.2 Order confirmation

Each order placed on the site will be confirmed via the email address communicated at the time of purchase. If you do not receive confirmation, you must contact us at the following email address: [email protected]


Article 3 : Price, availability and delivery

3.1 Prices

The prices presented on the Site are indicated in Euro (€), all taxes included (TTC) excluding participation in shipping costs, or other possible costs (transport insurance, customs clearance on arrival, etc.). The Value Added Tax (VAT) at the current rate (20%) is included in the sale prices displayed with the mention "TTC".

3.2 Availability

Despite all our efforts, it is possible that the number of bottles on a photo does not correspond to the stock displayed and that the stock displayed does not correspond to the real stock or that a price indicated is wrong. If, despite our vigilance, the items you ordered are unavailable, We will inform You by e-mail or by phone as soon as possible in order to maintain your order partially, to modify it or to proceed to a total cancellation.

If, in spite of our vigilance, the articles that you ordered contain a price error, be assured that we proceed to the verification of the prices during the procedure of sending of your article. If the corrected price is higher than the price displayed on the Site, We will inform You beforehand and proceed to cancel your order unless You choose to accept the order at the new price. We will do the same if the price should be lower!

If you choose to pay by check, we will hold your order for 10 business days while we receive your check and process it. In the event that you miss your 10 day commitment we will release your reservation. However your invoice will remain effective if the products are still available. If one or more products disappear after this release we will contact you to modify your order or to cancel it.

We remind you that any payment by credit card is debited at the time of validation of your order. Therefore, in the event that an item is no longer available or invalidated by You, and that no replacement item could suit You, a credit card re-credit or a refund transfer will be made.

Considering the rare or speculative character of certain products we reserve the right to apply restrictions on the quantities available, even to refuse or cancel an order presenting a manifestly abnormal character.

In addition, 1% of the order value will be charged as insurance. The insurance is charged regardless of the amount of the order shipped, the destination and the mode of transport, whether normal or express. This insurance allows us to reimburse you for the totality of the damage in case of loss, theft or breakage.

3.3 Delivery

The preparation for shipment of your order is made upon validation of your payment.

The delivery of the product(s) is carried out in France, at your home or at any address that you will have chosen at the time of your order, within approximately seven working days, excluding any case of force majeure (extreme temperature, strike, public holidays etc...). The approximate delivery time for any order to be delivered in Europe is about ten working days. The delivery time to other destinations is variable. It can be communicated on request before or after placing the order. If your destination is not proposed by our Site, we invite you to contact us: [email protected]

At the time of each reception of order you must check the external state of each box to check that the guarantee band was not opened during transport. You must also check the inside of the packages to make sure that the bottles are in one piece. In case of damage, you must mention it on the carrier's receipt, take pictures of the package and inform us within 48 hours of receipt. No claim can be accepted if the 48 hours deadline is exceeded.

In case of theft, non-delivery or breakage during the transport of your order, we will proceed with a new shipment of the product(s) concerned as soon as we have completed the investigation with the carrier in charge of your delivery. In certain cases (e.g. usurpation of your signature on the proof of delivery and absence of delivery), you may be asked to file a complaint with the police or the gendarmerie. You agree to do so within 48 hours after request from our services.

If the items you have ordered are unavailable, we will contact you to agree on the action you wish to take: replacement of the missing product(s) or refund of their value.

Any order delivered outside France may be subject to possible taxes and customs duties that are imposed when the package reaches its destination. These possible taxes and customs duties related to the delivery of an item are at your charge and are your responsibility. We are not obliged to check and inform You of the applicable customs duties and taxes. To know them, We advise You to inquire with the competent authorities of your country.


Article 4 : Payment

You can pay for your purchase by credit card, by check or by bank transfer.

The cards issued by banks domiciled outside France must be international bank cards. In case of payment by credit card, the amount of your order is debited at the time of its validation.

Payment by bank check is only possible for checks in euros (€) issued by a bank domiciled in France or Monaco. In case of payment by check, the check is cashed upon receipt. In addition, you must post your letter with the current rate...

The check should be made out to "Wine RL" and sent to the following address

The payment by bank transfer can be made on our bank account domiciled in France. The possible bank charges of your transfer will have to be entirely taken in charge by your bank. In case of incomplete transfer, a balance payment will be requested.

As soon as your payment by credit card, check or transfer is validated, your invoice will be available in your customer area, after logging in with your login and password chosen when creating your account.


Article 5 : Returns

Pursuant to the provisions of Article L.121-16 of the Consumer Code, You have the right of withdrawal to return the article(s) without having to justify your reasons. You must however imperatively indicate to Us your wish of retractation by email or mail before any return. You then have a period of fourteen (14) days following the date on which You received the product concerned, the signature of the delivery note of the carrier being evidence. You are responsible for the return shipping and insurance costs (covering the full amount of the returned product(s)).

If the withdrawal period is exceeded, no return is admissible. The possible expenses that You would have engaged would be lost.

However, we cannot accept returns for the following reasons: The bottle does not suit you during the tasting (deviating, oxidized or simply the wine does not please you despite these gustatory qualities) The bottle has a visual defect (damaged label, damaged cap) even if we take all our precautions to send you your packages. A visual defect will not alter the taste of the bottle. In case of a corked bottle, you can return the bottle to us at your expense with the cork and the proof of purchase from WINE RL. We will then forward the bottle to the producer or merchant for analysis. We will keep you informed of the verdict, in case of a positive answer we will make you a gesture on your next order or we will change the bottle.

A photograph of each product offered in a non-standard condition is available on our Site or on request. It is your responsibility to ask for it at the following address: [email protected] before any purchase of a product.

The photos of products published on the site have no contractual character, they are used as indicative and illustrative.


Article 6: Reservation of ownership


The delivered goods will remain our property until they are shipped (by handing them over to the designated carrier), once You have paid the full price (including goods and related costs).

Article 7 : Guarantees and liability

We decline any responsibility in the hypothesis where the delivered article would not respect the legislation of any other country of delivery than France. Our responsibility will not be engaged in the event of delay due to a possible shortage of stock.

Moreover, in case of differences between the photographs of presentation of the articles on our Site, texts and illustrations and the ordered articles, our responsibility will not be engaged.


Article 8: Licence to access the Site

When you visit www.winerl.com we grant you a limited license to access and use the site for your personal use only. Under no circumstances may you download any image or copy any text, in whole or in part. This license does not allow you to use, for sale or for any other commercial use this site or its contents. This site or any part of this site may not be reproduced, copied, sold or otherwise exploited for any commercial purpose without our express written permission.

You may not use any techniques to copy any trademark, logo or other information (including images, text, designs) owned by us without our express written consent. Any unauthorized use will terminate the license we have granted you.

The use of our logo/brand or images requires our permission prior to any use.


Article 9: Protection of personal data

WINE RL is committed to protect your data and not to disclose them to a third party without your written consent. However, your data will be used exceptionally to inform our partners to ensure your order: our banking partners, our carriers, and our computer developers.
